These Terms of Use (“Terms”) govern your access to and use of the BerksGo website, mobile application, and transportation-related services (collectively, the “Services”) provided by PistaNet Technologies, LLC (“PistaNet,” “BerksGo,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.
PistaNet Technologies, LLC operates BerksGo as a passenger transportation service. The BerksGo application is the company’s electronic reservation, dispatch, and customer trip-information system. This website does not offer public operator signup.
1. Eligibility and accounts
You must provide accurate information when creating or maintaining an account and keep your account credentials secure. You are responsible for activity conducted through your account. Rider eligibility requirements may apply, including age or other requirements communicated through the Services.
2. Transportation requests and availability
Through the BerksGo application, riders may request transportation and may receive estimated trip cost, estimated pickup or travel time, assigned operator information, assigned vehicle information, and trip status or other trip details. Availability depends on factors including location, service area, timing, road conditions, demand, operational constraints, and the availability of a company-authorized operator and vehicle. A requested ride is not guaranteed until the applicable ride flow confirms it.
3. Fares, payments, and adjustments
Before or during a ride request, BerksGo may display estimated pricing or other payment information. Final charges may reflect permitted adjustments associated with the actual trip, approved or unexpected stops, waiting, cancellation terms, or other circumstances disclosed through the Services. Payments may be processed through third-party payment providers. You authorize applicable charges associated with Services you request or receive, subject to the information presented in the app and applicable law.
4. Cancellations
Cancellation terms and any applicable cancellation fee will be communicated through the Services. Riders may cancel a requested ride, but a fee may apply after the applicable cancellation threshold has been reached. BerksGo may also cancel or restrict a ride when reasonably necessary for safety, fraud prevention, service integrity, legal compliance, or operational reasons.
5. Rider responsibilities
Riders must provide accurate pickup, destination, passenger-count, and trip information; be reasonably ready at the pickup location; treat the assigned operator and others respectfully; comply with applicable law; avoid dangerous, abusive, fraudulent, or disruptive conduct; and pay charges properly due for requested Services. Riders are responsible for ensuring that any passenger for whom they request a ride complies with applicable requirements.
6. Authorized operators
Transportation is provided using company-authorized operators and vehicles. Authorized operators must maintain legally required licenses, registrations, insurance, and vehicle qualifications, operate safely and lawfully, provide accurate operational information, and comply with applicable BerksGo safety and service requirements. Operator or vehicle assignment may be limited or changed when eligibility, safety, fraud, documentation, or compliance concerns arise.
7. Safety and emergencies
BerksGo is not an emergency-response service. In an emergency, contact the appropriate local emergency service. Users must not use the Services for unlawful, dangerous, threatening, harassing, discriminatory, fraudulent, or abusive conduct. BerksGo may investigate reported safety issues and may restrict access when reasonably necessary to protect users or the Services.
8. Ratings, feedback, and support
The Services may allow users to provide ratings, feedback, support requests, or safety reports. Information submitted must be truthful to the best of your knowledge and must not be used to harass, threaten, defraud, or unlawfully discriminate against another person.
9. Location and communications
Certain features depend on location information and service-related communications. You control device permissions through your device settings, although disabling a permission may prevent a dependent feature from functioning. We may send transactional or service-related communications needed to operate your account or trip.
10. Acceptable use
You may not misuse the Services, attempt unauthorized access, interfere with their operation, introduce malicious code, impersonate another person, manipulate ride or payment systems, use the Services to commit fraud or other unlawful acts, or violate the rights or safety of others.
11. Third-party services
BerksGo may use or integrate third-party services, including payment, mapping, hosting, database, device-platform, and communications services. Your use of third-party features may also be subject to the applicable provider's terms and privacy practices.
12. Intellectual property
The BerksGo name, branding, software, website content, graphics, text, and other materials are owned by or licensed to PistaNet Technologies, LLC unless otherwise indicated. These Terms do not transfer ownership of BerksGo intellectual property to you.
13. Suspension and termination
You may stop using the Services and may initiate account deletion through the BerksGo app. We may suspend or terminate access when reasonably necessary because of fraud, safety concerns, material violations of these Terms, legal requirements, eligibility issues, misuse, or threats to the Services or other users.
14. Service changes and disclaimers
Features, service areas, availability, and operational procedures may change. To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, a particular assigned operator or vehicle, a particular route or arrival time, or freedom from all errors or service interruptions.
15. Limitation of liability
To the fullest extent permitted by applicable law, PistaNet Technologies, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
16. Governing law
These Terms are governed by applicable law, including the laws of the Commonwealth of Pennsylvania where applicable, without overriding rights or protections that cannot lawfully be waived.
17. Changes to these Terms
We may update these Terms as the Services, operations, or legal requirements change. Updated Terms will be posted on this page with a revised “Last updated” date. Where required, we will provide additional notice or obtain consent.
